Submission and Usage Policy

This policy explains how KETC collects and uses information submitted in connection with the “Viewers share their stories” project. We recognize the value of personal privacy and copyright protection and wish to protect your information and copyright holders. This “St. Louis Stories” project is maintained and hosted by KETC. The “St. Louis Stories” project may make use of information submitted to KETC in an online database of submitted stories available on the KETC web site or web sites maintained by KETC, as well as in KETC televised programming and as part of the KETC collection at the Missouri Historical Society and other uses as determined by KETC.

Content submitted by the public
The “St. Louis Stories” project allows the public to share personal stories. The following types of submissions are permitted:

  • Personal, factual stories about life and experiences. Information about products, services or commercial interest should not be included.
  • Comments on stories submitted by the public
  • E-mailing a story from the public to a friend

Content may be submitted by regular mail or electronic mail, by posting/uploading in the “St. Louis Stories” section of the KETC web site, or by posting/uploading content in the KETC sponsored groups on the YouTube and Facebook web sites. Making a submission in any form requires your acceptance of these terms and conditions.

Policies governing your submission of content
You are responsible for the content of any information you submit for use in connection with the “St. Louis Stories” project. The information used in connection with this project does not necessarily reflect the views of KETC or PBS and in no event shall KETC or PBS assume or have any responsibility or liability for any information submitted for use with this project or for any claims, damages or losses resulting from the use and/or appearance of such information in connection with this project.

By making a submission in any form to KETC in connection with the “St. Louis Stories” project, you affirm that your submission, including text, digital images and video, is original to you, that you hold all necessary rights to this work or have permission from the copyright holder, or the work is in the public domain, and that the submission does not defame or otherwise violate the rights, copyrights, trademarks, publicity, privacy, or reputation of any third party.

 

By making your submission to the “St. Louis Stories” project you expressly grant KETC and PBS your permission to record, edit, transcribe, duplicate, distribute, and perform your submission, in any and all media now existing or hereafter developed, throughout the world. You also grant KETC and PBS the right to use your name, likeness, and voice in connection with the use and/or republication of your submission.

 

Under this agreement you will retain ownership of the copyright of your submission. However, as a condition of use of your submission and for no monetary compensation, you hereby grant to KETC and PBS and KETC and PBS hereby accept a perpetual, royalty-free, worldwide license to reproduce, distribute, prepare derivative works of, display and perform such information in any and all media now known or hereinafter devised and to authorize others to exercise such rights. You further represent that you have all necessary rights in your submission. Any items submitted to KETC cannot be returned.

You agree to indemnify and hold KETC and PBS harmless against any claims asserted by any third parties that allege your submission violates their rights, or from any breach by you of your promises in this agreement. You shall be responsible for any costs incurred by KETC and PBS for defense or settlement of third- party claims, including but not limited to KETC and PBS reasonable attorneys’ fees.

You understand that submitting content does not guarantee that your work will be displayed on this web site or otherwise used by KETC or PBS. The decision of which and how each submission received by KETC will be used will be at the sole discretion of KETC and PBS. Stories and comments submitted to and approved by KETC may be available for public viewing on the “My St. Louis Stories” project of the KETC web site or web sites maintained by KETC, on KETC’s televised programming, and as part of the KETC collection at the Missouri Historical Society.

Notice of Intellectual Property Infringement
KETC and PBS respect the intellectual property rights of others. In accordance with the Digital Millennium Copyright Act (DMCA) and other applicable law, it is the policy of KETC and PBS to terminate, in appropriate circumstances, the account of any user who is deemed to infringe third party intellectual property rights. If you believe that your work has been copied in a way that constitutes copyright infringement or are aware of any infringing material placed by any third party on http://www.ketc.org, please provide the following information to our Copyright Agent:

1. an electronic or physical signature of the person authorized to act on behalf of the owner of the copyright or other intellectual property interest;

2. a description of the copyrighted work or other intellectual property that you claim has been infringed;

3. a description of where the material you claim is infringing is located on the site;

4. your address, telephone number, and email address;

5. a statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;

6. a statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright or intellectual property owner or authorized to act on the copyright or intellectual property owner’s behalf.

Protecting your personal information
We collect personally-identifying information such as your name and e-mail address on these pages. We ask you to provide this information when you submit a story, or make a comment on a story, or request to send a story to a friend. Please note, your name and location will be displayed on the KETC web site or other web site maintained by KETC. In addition, you name and location may be displayed in connection with any use of your submission by PBS or parties authorized by PBS. When submitting your name, you are advised to use a name that you want the public to see. E-mail addresses will only be used for administrative purposes by KETC and PBS. Your E-mail address will not be shared or sold to a third party without first receiving your permission.

We limit the use of personally-identifying information to the following activities: identifying the contributor of a story posted to this web site, identifying the contributor of a comment about a story, and fulfilling your request to e-mail a story to a friend.

 

We also may disclose personal information if required to do so by law or if we believe that such action is necessary to (a) comply with the law or with legal process, (b) protect against misuse or unauthorized use of the web site, or (c) protect the personal safety or property of web site users and the public. If you do not want your personally-identifying information to be collected or used for any of these purposes, you can simply ‘opt out’ according to the process described below.

 

Tracking and use of cookies for online submissions

If you take advantage of the “St. Louis Stories” portion of the KETC web site, it is possible that several cookies will be set on your computer. A cookie is information a web site puts on your computer’s hard drive so that the site can remember your preferences or which pages you visited on that site. These web pages use the information from cookies to deliver relevant local resources, remember browser preferences, and improve your experiences on the site.

No personal information gathered in the “St. Louis Stories” portion of the KETC web site will ever be stored in a cookie. KETC and PBS do not sell information collected by cookies nor use the information for commerce-related purposes.

Links to other sites

The “St. Louis Stories” portion of the KETC web site may contain links to other sites that may not follow the same privacy policies as we do. These sites may use cookies, collect data, and use the data in ways that we would not. We are not responsible for the privacy practices or any information or materials on these other sites.

 

Acceptance of the Submission & Usage Policy

For online submissions, you signify your acceptance of the terms spelled out in this agreement by clicking the “Submit” button on any submission/comment form in the “St. Louis Stories” portion of the KETC web site or web sites maintained by KETC. If you do not agree to these terms and conditions, please do not use this portion of the KETC web site or otherwise make a submission to the “St. Louis Stories” project.

 

By making a submission to the “St. Louis Stories” project, you expressly grant KETC permission to use and edit the submission in its sole discretion and to use your name in connection with the use and/or republication of your submission. All submissions are subject to our Submission & Usage Policy.

 

We reserve the right to change this policy at any time. Any changes to this policy will be posted to this page as soon as reasonably possible, so please check this page periodically. Use of these pages constitutes consent to any policy then in effect.

 

Disclaimer of warranties

THE “St. Louis Stories” PROJECT AND THIS PORTION OF THE KETC WEB SITE ARE PROVIDED ON AN “AS IS” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF TITLE, NONINFRINGEMENT, OR IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. NEITHER PBS NOR THE MEMBER STATIONS WARRANT THAT ANY INFORMATION IS COMPLETE OR ACCURATE, THAT THE KETC WEB SITE OR PBS WILL BE UNINTERRUPTED OR ERROR FREE OR THAT ANY INFORMATION IS FREE OF ROGUE PROGRAMMING.

Limitation of damages

UNDER NO CIRCUMSTANCES, INCLUDING NEGLIGENCE, SHALL KETC OR PBS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE OR CONSEQUENTIAL DAMAGES THAT MAY RESULT FROM THE USE OR INABILITY TO USE THE “St. Louis Stories” PROJECT, INCLUDING WITHOUT LIMITATION USE OF OR RELIANCE ON INFORMATION AVAILABLE ON THE “St. Louis Stories” PROJECT, INTERRUPTIONS, ERRORS, DEFECTS, MISTAKES, OMISSIONS, DELETIONS OF FILES, DELAYS IN OPERATION OR TRANSMISSION, NONDELIVERY OF INFORMATION, DISCLOSURE OF COMMUNICATIONS, OR ANY OTHER FAILURE OF PERFORMANCE.

 

Release and indemnity

YOU HEREBY RELEASE AND WAIVE ANY AND ALL CLAIMS AND/OR LIABILITY AGAINST KETC AND PBS ARISING FROM OR IN CONNECTION WITH YOUR USE OF THE “St. Louis Stories” PORTION OF THE KETC WEB SITE OR WEB SITES MAINTAINED BY KETC OR YOUR SUBMISSION OF INFORMATION IN ANY MANNER TO KETC IN CONNECTION WITH THE “St. Louis Stories” PROJECT. YOU ALSO AGREE TO DEFEND, INDEMNIFY AND HOLD HARMLESS, PBS AND THE MEMBER STATIONS, FROM AND AGAINST, ANY AND ALL CLAIMS OR LIABILITY, INCLUDING COSTS AND ATTORNEYS FEES, ARISING FROM OR IN CONNECTION WITH YOUR USE OF THIS PORTION OF THE KETC WEB SITE OR WEB SITES MAINTAINED BY KETC, YOUR SUBMISSION OF INFORMATION IN ANY MANNER TO KETC IN CONNECTION WITH THE “St. Louis Stories” PROJECT, OR FAILURE TO ABIDE BY APPLICABLE LAW.
